Last year, as a result of the Fifth European Motor Directive, the Motor Insurers’ Bureau removed the £300 property damage excess for claims under the Untraced Drivers’ Agreement (where the other vehicle had been identified) and also enabled claimants who sustained significant personal injury to claim for property damage, even where the vehicle had not been identified, although the £300 excess now applied to such claims. These changes, however, applied only to accidents that occurred on or after the 15 April 2011.
The MIB have agreed, together with the Department for Transport, that these changes will now apply to accidents that occurred between 11 June 2007 and 14 April 2011. This arrangement came into effect on the 1 March 2012.
